MORROW, Ga. (NEWSnet/AP) — A special prosecutor announced Tuesday he will dismiss charges against the Atlanta police officer who fatally shot Rayshard Brooks in 2020.

Garrett Rolfe was one of the officers who responded to complaints of a man sleeping in a car in the drive-thru lane of a Wendy's restaurant.

When the officers told Brooks he'd had too much to drink to be driving and tried to arrest him, Brooks resisted in a struggle caught on dash camera video.

Brooks grabbed a taster from one of the officers - firing it at Rolfe as he ran away. Rolfe fired his service weapon, hitting Brooks twice in the back.

Pete Skandalakis, executive director of the Prosecuting Attorneys’ Council of Georgia, said both officers acted within established practices and used justifiable force.
